GENERAL TERMS AND CONDITIONS 

These general terms and conditions of sale are entered into between the company MAC PRIVATE CHAUFFEUR By Mac Transport sprl, operator of a chauffeur-driven vehicle rental service and holder of authorization No. 11131, issued by the city of Brussels on 07/02/2023 in accordance with Article 41 of the decree of April 20, 2001 relating to the organization of the transport of persons by road, hereinafter referred to as “the operator”, on the one hand; and any person, acting in a professional capacity or not, (hereinafter the “Client”) wishing to book a chauffeur-driven car service or PHV (Private Hire Vehicle) (hereinafter the “Service”) for their own account or for that of individuals duly authorized for this purpose (the “Passenger(s)”). Booking a Service with MAC PRIVATE CHAUFFEUR By Mac Transport sprl constitutes full and unreserved acceptance by the Client and Passengers of the general terms and conditions of sale of MAC PRIVATE CHAUFFEUR By Mac Transport sprl (hereinafter the “Terms of Sale” or “GTC”). Any conflicting condition put forward by the Client or Passenger, in particular any conflicting clause arising from their own terms and conditions, shall not be enforceable against MAC PRIVATE CHAUFFEUR By Mac Transport sprl, except with the express, written, and prior acceptance of the latter. MAC PRIVATE CHAUFFEUR By Mac Transport sprl reserves the right to modify the GTC at any time. The Terms of Sale applicable to the booking of a Service are those in force on the date of the firm booking of the Service (hereinafter “the Booking”), evidenced by MAC PRIVATE CHAUFFEUR By Mac Transport sprl’s receipt of written confirmation of the booking. MAC PRIVATE CHAUFFEUR By Mac Transport sprl guarantees the proper organization and smooth running of the assignments entrusted to it as a passenger transport company.

1. BOOKING/NOTICE

 

To book and/or pay for a Service, the Client must be of legal age or an emancipated minor, be legally capable of entering into a contract, and comply with the General Terms and Conditions of Sale. The Client is responsible for the bookings they make both in their own name and on their own behalf and on behalf of the Passengers when acting on their behalf. The Client guarantees the truthfulness and accuracy of the information they provide.

BOOKING REQUEST

A request to book a Service may be made by telephone, by email, via the Waynium website, and by any other means approved by MAC PRIVATE CHAUFFEUR By Mac Transport sprl. When made by telephone, the booking request must necessarily be confirmed in writing, in particular by email or via the website of MAC PRIVATE CHAUFFEUR By Ma Transport sprl. The booking request must include the following minimum information: Dates, times and routes:

  • The date, time and place of initial pickup of the Passenger(s)
  • The final drop-off location and any intermediate stops to be observed, if any
  • The number of people to be transported (specify whether the passenger has reduced mobility and/or is in a wheelchair)
  • The approximate number, weight and overall volume of luggage. Means of communication
  • Passenger’s telephone contact details
  • Passenger’s email address
  • Desired vehicle model or category. For any new Client, the booking will only be confirmed after MAC PRIVATE CHAUFFEUR By Mac Transport sprl has verified the Client’s means of payment (see “Payment” section below).

 

ISSUANCE OF A QUOTE

Upon receipt of the booking request, MAC PRIVATE CHAUFFEUR By Mac Transport sprl will prepare a quote based on the information provided by the Client or Passenger. Any change in the information provided may modify the initial price of the Service (change of vehicle model, capacity, mileage, exceeding duration, etc.). Furthermore, any service not included in the quote will be billed in addition to it.

BOOKING CONFIRMATION

If the quote is accepted, the Client must confirm their booking in writing to MAC PRIVATE CHAUFFEUR By Mac Transport sprl by a means approved by the latter (“the Booking Confirmation”). Receipt by MAC PRIVATE CHAUFFEUR By Mac Transport sprl of the Booking Confirmation constitutes the formation of the transport contract between MAC PRIVATE CHAUFFEUR By Mac Transport sprl and the Client.

2. RATES

Services are offered at the rates indicated in the MAC PRIVATE CHAUFFEUR By Mac Transport sprl price schedule attached to the quote. Pricing rules are subject to variation depending on certain circumstances such as public holidays, peak periods, pickup zone and/or use of the Service, time of day, etc. Rates are quoted inclusive of all taxes and include:

THE CHAUFFEUR SERVICE

Fuel. Professional civil liability insurance for “transported persons” for a fee. VAT at the rate set by current regulations.

Unless expressly stated otherwise in the quote, rates do not include urban toll systems, highway tolls, parking meters, parking fees, entrance fees to sites, public or private properties, or driver meals. The latter are billed for any Service order lasting more than three (3) hours:

  • Ending after 1:00 PM
  • Starting before 1:00 PM
  • Ending after 8:45 PM
  • Starting before 9:00 PM.
A driver travel allowance will be charged for overnight stays outside the Brussels Region. The price of the Service indicated in the quote issued by MAC PRIVATE CHAUFFEUR By Mac Transport sprl may be revised by the latter to take into account, in particular, increases in fuel prices and any costs incurred in carrying out the Service. Additional fees may be charged in the event of a specific request from the Client, such as a baby seat or special refreshments. The amounts billed will be specified in the quote or Booking Confirmation. MAC PRIVATE CHAUFFEUR By Mac Transport sprl reserves the right to change the price schedule at any time without notice. These changes will be communicated to the Client and will apply to all Services booked after the price schedule is updated.
 

OVERTIME OR MILEAGE OVERAGE (EXCLUDING TRANSFER SERVICES)

For any Service, MAC PRIVATE CHAUFFEUR By Mac Transport sprl may set a minimum billing amount specified in the quote. At any time during a Service, the Client may decide to change the destination or interrupt it. In this case, the Client will be billed for the time and distance actually traveled, and at a minimum for the package agreed upon at the time of booking.
Any time exceeding the scheduled return time will be billed in addition based on the rate in effect indicated in the price schedule. Any mileage overage will also be billed according to the rates in effect indicated in the price schedule.

3. TERMS OF SERVICE EXECUTION — PASSENGER PICKUP

The Passenger(s) must comply with the pickup rules indicated by MAC PRIVATE CHAUFFEUR By Mac Transport sprl and/or the Chauffeur assigned to carry out the Service. MAC PRIVATE CHAUFFEUR By Mac Transport sprl shall not be held liable in the event that failure by the passenger(s) to follow the pickup procedure prevents the Service from being carried out. Traffic laws require Passengers to wear seatbelts in both the front and back of the vehicle. Failure to comply with this rule releases MAC PRIVATE CHAUFFEUR By Mac Transport sprl from liability in the event of an accident. MAC PRIVATE CHAUFFEUR By Mac Transport sprl maintains a strict no-smoking policy in all of its vehicles. Failure to comply with this provision will result in cleaning and restoration fees being charged at a flat rate of €250 including all taxes. The same applies to vomiting. Unless expressly authorized in writing by MAC PRIVATE CHAUFFEUR By Mac Transport sprl, alcohol consumption is not permitted in the vehicles. The Driver and/or MAC PRIVATE CHAUFFEUR By Mac Transport sprl have the right to refuse to transport any Passenger who is believed to be under the influence of alcohol or drugs and whose behavior constitutes a threat to the driver, the car, or any other passenger. MAC PRIVATE CHAUFFEUR By Mac Transport sprl may choose to subcontract, transfer, or assign all or part of the Service to a third party of its choice, without prior notice to the Client. The photographs and images available on the MAC PRIVATE CHAUFFEUR By Mac Transport sprl website, its brochures, and any presentation documentation are not contractually binding.

MAC PRIVATE CHAUFFEUR By Mac Transport sprl will not be liable if the car and/or driver does not match the photographs or images. MAC PRIVATE CHAUFFEUR By Mac Transport sprl states that the vehicles used to carry out the Services are equipped with a geolocation system. By accepting the Services of MAC PRIVATE CHAUFFEUR By Mac Transport sprl, the Client consents to the use of this geolocation system.

LUGGAGE POLICY

The total weight of luggage is limited to what is compatible with the vehicle used, within the limits of the available space. The driver and/or MAC PRIVATE CHAUFFEUR By Mac Transport sprl may refuse luggage or items exceeding this limit. In particular, for safety reasons, MAC PRIVATE CHAUFFEUR By Mac Transport sprl will refuse to load any bulky luggage into the passenger compartment. MAC PRIVATE CHAUFFEUR By Mac Transport sprl will not be held liable for any loss of luggage during or after the Service. The Passenger’s personal belongings are their own responsibility, and MAC PRIVATE CHAUFFEUR By Mac Transport sprl will not be held liable for any loss or damage to these belongings.

VEHICLE CAPACITY – NUMBER OF PASSENGERS TRANSPORTED

The maximum number of passengers in the car (including the Chauffeur) must not exceed the maximum number of passengers stated in the car’s technical specifications. The Chauffeur and/or MAC PRIVATE CHAUFFEUR By Mac Transport sprl reserves the right to refuse a passenger exceeding these limits.

PETS

Small dogs and other small pets weighing no more than 6 kg, properly enclosed in a container not exceeding 45cm x 30cm x 25cm, are accepted on board vehicles, up to a limit of two. Subject to this restriction, no other pets are accepted on board vehicles.

4. MODIFICATION AND CANCELLATION OF BOOKING

Requests for modification or cancellation are made using one of the processes authorized for booking Services. Any modification or cancellation of the Booking must be made with MAC PRIVATE CHAUFFEUR By Mac Transport sprl at least two (2) hours before the agreed time of the Service. After this deadline, MAC PRIVATE CHAUFFEUR By Mac Transport sprl will bill all or part of the booked Service according to the terms set out below.

CONDITIONS APPLICABLE TO ANY SERVICE

Any external incidental costs incurred by MAC PRIVATE CHAUFFEUR By Mac Transport sprl (guides, hostesses, security agents) as part of a Service canceled less than 24 hours before the agreed start time will be billed in full.

CONDITION APPLICABLE TO ANY SERVICE PROVIDED IN SEDAN, MINIBUS AND VAN:

In the event of a late cancellation (less than two hours before the agreed time of the Service) or a “no show” 60 minutes after the pickup time set at the time of booking the Service, the Client will be charged the higher of two amounts: the price of the transfer from the scheduled pickup location to the garage, or the cost of the time actually spent waiting for the Client at the meeting point. In the event of a Booking modification, the Service actually provided will be billed.

CONDITIONS APPLICABLE TO ANY SERVICE PROVIDED BY COACH WITH MORE THAN 9 SEATS

In the event of a late cancellation (less than two hours before the agreed time of the Service) or a “no show” 60 minutes after the pickup time set at the time of booking the Service, the Client will be billed the full amount of the Service originally scheduled, multiplied by the following percentage: Between 72 hours and 48 hours before the start of the Service: 10% Between 48 hours and 24 hours before the start of the Service: 50% Less than 24 hours or No Show: 100% MAC PRIVATE CHAUFFEUR By Mac Transport sprl reserves the right to apply different cancellation or modification terms, particularly during periods of high activity or for Services involving a large number of Vehicles. These special terms will appear in the quote or order summary received by the Client and will take precedence over these provisions.

5. DELAY

MAC PRIVATE CHAUFFEUR By Mac Transport sprl is not responsible for delays caused by force majeure and/or for reasons beyond its control (strikes, natural disasters, train/plane delays). DRIVER DELAY. The driver is considered late if he arrives after the meeting time set at the time of booking the Service. In the event of a delay, MAC PRIVATE CHAUFFEUR By Mac Transport sprl will contact the Client to notify them of the delay and, if pickup is not possible, will offer an alternative solution. In the absence of an alternative solution, the Client may be compensated, indemnified, or reimbursed, it being understood that the amount reimbursed, as well as the liability of MAC PRIVATE CHAUFFEUR By Mac Transport sprl, will be limited to the amount agreed for the booked Service or, where the latter is not determined, to a maximum of 150 Euros. CLIENT DELAY. The Driver is required to wait for the Client for 60 minutes after the agreed meeting time. After this period, the Client who is not present at the pickup point is considered absent (“no-show”). In this case, the Client will be billed the higher of two amounts: the price of the transfer from the scheduled pickup location to the garage, or the cost of the time actually spent waiting for the Client at the meeting point. transfer to the garage, on the one hand, and the cost of the time actually spent waiting for the Client at the meeting point, on the other.

5. DELAY Clients (a)

Late clients will be billed as follows, based on the price indicated on the Waynium account, which varies depending on the vehicle chosen:

5 minutes after the appointment time for a location other than airports or train stations. After a 30-minute delay past the appointment time for Airports and Train Stations:

  • Sedan: €1.18 excl. VAT per minute
  • Luxury Van: €1.25 excl. VAT per minute
  • Luxury Sedan: €1.42 excl. VAT per minute
  • Luxury Business: €2.20 excl. VAT per minute

The Waynium geolocation system will directly record the driver’s and vehicle’s delay minutes while on assignment, without the company Mac PRIVATE CHAUFFEUR By Mac Transport SPRL being able to modify them. These will only begin once the driver is within approximately 20 meters of the address provided by the client.

6. COMMITMENT AND LIABILITY

MAC PRIVATE CHAUFFEUR By Mac Transport sprl acts as a chauffeur-driven passenger transport company and, as such, declares that it complies with current professional regulations. It assumes the safety obligation incumbent upon any professional carrier towards the persons transported, as well as the responsibilities related to the control of the passenger transport vehicle, whether owned or leased. MAC PRIVATE CHAUFFEUR By Mac Transport sprl declares that it holds an insurance contract covering its professional civil liability in connection with the exercise of the passenger transport activity, and in particular all financial consequences of bodily, material, and immaterial damages for which it may be liable in connection with the provision of the Services, notably following a traffic accident, from the moment the passenger boards the Vehicle until they disembark, except for damages caused by the passenger’s fault. MAC PRIVATE CHAUFFEUR By Mac Transport sprl assigns to the Services drivers holding the required regulatory qualifications, carefully selected, in line with the Client’s needs and requests.

7. DAMAGE

The Client will be liable for any damage caused by them or by persons with them in the car (excluding the Chauffeur) or the Passenger(s) during the Service, inside the Car, and will be billed accordingly for any repair or servicing necessary to restore the Car to good working order and/or cleanliness and/or presentation.

8. PAYMENT AND SUPPORTING DOCUMENTS

 

SERVICE PAYMENT TERMS

MAC PRIVATE CHAUFFEUR By Mac Transport sprl accepts the following payment methods: cash, bank cards (Visa, American Express, Diners Club, MasterCard), and bank transfers (fees charged to the sender). When booking the Service, the Client must provide the following documents:

  • A valid credit card number (including the security code)
  • A copy of their identity card, passport, or equivalent document. Before carrying out the Service, MAC PRIVATE CHAUFFEUR By Mac Transport sprl verifies with the Client’s bank that their account has sufficient funds to cover the amount of the Service. MAC PRIVATE CHAUFFEUR By Mac Transport sprl may charge a token amount (<€10) to verify the validity of the bank card provided as a guarantee (this amount being deducted from the final invoice). MAC PRIVATE CHAUFFEUR By Mac Transport sprl may also request a pre-authorization hold for the estimated amount of the Services from the Client’s bank. If the card provided as a guarantee is invalid or the account to be debited has insufficient funds, the booking made by the Client cannot be confirmed by Chabé and the Service that is the subject of said booking will not be carried out. Any payment by American Express will result in payment fees of 3.0% (three percent) of the invoice amount.

 

INVOICING – PAYMENT

The Service will be billed as of the date indicated in the Booking. MAC PRIVATE CHAUFFEUR By Mac Transport sprl will send the Client the final invoice for the Service by email, taking into account any additional fees or applicable modifications. The Service is payable in cash upon completion. The Client is informed that the charge may occur immediately after the Service is performed. In the case of Services carried out over several consecutive days, MAC PRIVATE CHAUFFEUR By Mac Transport sprl may charge the estimated amount of the previous day’s Service each day, with MAC PRIVATE CHAUFFEUR By Mac Transport sprl responsible for reconciling the final amount based on the Services billed. If the person transported has “account client” status, the Service will be invoiced payable upon receipt, before the 15th of the month following the month in which it was performed, unless otherwise expressly stated.

LATE PAYMENT

Any late payment automatically results, from the day following the payment date shown on the invoice, in the payment of penalties in an amount at least equal to three times the legal interest rate, as well as the application of a flat-rate administrative collection fee of €40 excluding tax per unpaid invoice (“the Penalties”), in accordance with the provisions of Article L441-6 of the French Commercial Code. MAC PRIVATE CHAUFFEUR By Mac Transport sprl’s inability to debit the Client’s account, for any reason whatsoever, constitutes a late payment resulting in the application of the aforementioned Penalties without notice.

COMPLAINTS

In the event of a dispute regarding the invoice amount or the terms of the Service, the Client may send a complaint to MAC PRIVATE CHAUFFEUR By Mac Transport sprl by registered letter with acknowledgment of receipt (LRAR) at the following address:

Any complaint is only admissible within 8 days of the completion of the Service concerned and must be in writing, otherwise it will not be taken into account.

9. PERSONAL DATA

These Terms are subject to regulations relating to the protection of personal data (in particular EU Regulation 2016/679 of April 27, 2016 and the French “Informatique et Libertés” law No. 78-17 of January 6, 1978). The personal data collected by MAC PRIVATE CHAUFFEUR By Mac Transport sprl in connection with the booking and provision of Services (notably via the geolocation system with which the Vehicles are equipped) is: Identification data as well as the Client’s postal, telephone and electronic contact details; The email and telephone contact details of the Passenger(s); Data relating to means of payment; Data relating to the Vehicle’s movements and location; Data relating to the Vehicle’s speed and distance traveled.

PURPOSES OF PROCESSING

The purposes of the processing of this data by MAC PRIVATE CHAUFFEUR By Mac Transport sprl are:
The preparation and performance of the contract, in particular:

  • Management of Service bookings and their confirmation;
  • Monitoring and invoicing of Services;
  • Emergency calls in the event of an incident or accident;
  • Management of complaints;
  • Fraud prevention.

The pursuit of MAC PRIVATE CHAUFFEUR By Mac Transport sprl’s legitimate interest in promotion and prospecting, in particular:

Client relationship monitoring (maintaining Client satisfaction, customer loyalty); Development of statistics and/or commercial analyses; Sending advertising information or commercial offers to propose goods or services similar to those covered herein. MAC PRIVATE CHAUFFEUR By Mac Transport sprl may only use the Personal Data provided by the Client to send them advertising information or commercial offers from its business partners subject to having obtained their consent. By accepting these GTC, the Client accepts the collection and processing of the aforementioned personal data for the purposes referred to above, by MAC PRIVATE CHAUFFEUR By Mac Transport sprl, the data controller.

DATA RETENTION

MAC PRIVATE CHAUFFEUR By Mac Transport sprl records and retains personal data relating to the Service for a period of three (3) years from the Booking. At the end of this period, the said personal data may be archived by MAC PRIVATE CHAUFFEUR By Mac Transport sprl in order to allow it to comply with its accounting, tax and legal obligations (in particular the 5-year limitation period applicable to the Contract/Article 2224 of the Civil Code; the 10-year period for the retention of invoices/L123-22 of the Commercial Code). MAC PRIVATE CHAUFFEUR By Mac Transport sprl has technical means in place to guarantee the confidentiality and security of the data collected.

CLIENT RIGHTS

The Client has the right to access data concerning them. They may at any time request:

  • The correction, updating and/or deletion of their personal data;
  • The restriction of the processing of their data;
  • The portability of their data;
  • Objection to the processing of their data for legitimate reasons. To exercise these rights, the Client may send their request by mail to:

  • The Client must include proof of identity in order to exercise the aforementioned rights.

10. INTELLECTUAL PROPERTY

The MAC PRIVATE CHAUFFEUR By Mac Transport sprl website, including but not limited to photographs, graphics, the customer interface, editorial content, scripts, and software, contains information and elements belonging to MAC PRIVATE CHAUFFEUR By Mac Transport sprl and/or its subcontractors, protected by intellectual property law. The Client expressly acknowledges that they must not use this information or documents except in accordance with the General Terms and Conditions. The Client must not copy, reproduce, display, or use any element of the MAC PRIVATE CHAUFFEUR By Mac Transport sprl website protected by intellectual property rights in any way whatsoever without the prior written consent of MAC PRIVATE CHAUFFEUR By Mac Transport sprl. The Client must not establish a connection, including via a hyperlink or “mirror,” whether electronically or otherwise, to any part of the website or an application without the prior written consent of MAC PRIVATE CHAUFFEUR By Mac Transport sprl.

11. APPLICABLE LAW

The General Terms and Conditions and any related contract are exclusively performed, governed by, and interpreted in accordance with French law. In the event of any discrepancy or conflict between the English and French versions of the General Terms and Conditions, the French version shall prevail. The English version is provided for information purposes only. In the event of a dispute, the Client shall contact MAC PRIVATE CHAUFFEUR By Mac Transport sprl to seek an amicable resolution of their complaint. Any dispute that cannot be resolved amicably shall be: Submitted to the exclusive jurisdiction of the courts if the Client is a consumer; Submitted to the exclusive jurisdiction of the Brussels Commercial Court if the Client is a merchant. Debt collection bailiff — company lawyer. If one or more provisions of these General Terms and Conditions of Sale are found to be null and void or unenforceable, the remaining provisions shall retain their full force and effect.

VERY IMPORTANT

The transport of persons for payment is a regulated activity. Only authorized vehicles (Chauffeur-Driven Vehicles; Occasional Transport) may provide this service, within the legal and regulatory provisions set out. We would like to caution our customers against certain companies or individuals who do not comply with these provisions and who cannot offer any guarantee.
